Filing of Collection Suit Triggers Fair Debt Act

Goldberg Kohn principal Daniel Shapiro was quoted in a Lawyers Weekly article regarding the Fair Debt Collection Practices Act, which requires a debt validation notice be sent to the debtor describing his rights within five days of a collector's first communication. A recent 2nd Circuit ruling enforced these protections and has intensified a circuit split. Mr. Shapiro offered his opinion from a collection lawyer's standpoint: "That's building a whole additional layer of activity and compliance into the statute which is just not there."
