Bill Meyers, Principal in the firm's Litigation Group, spoke at the 2008 Annual Electronic Discovery Conference in Chicago.
The conference provided the following workshop presentations to demonstrate best practices for major e-discovery challenges:
- "I want all the data - now!" Learn how to effectively manage the new meet and confer requirement from judicial, plaintiff, and defense perspectives. This diverse panel will provide essential advice for practice under Rule 26(f).
- First response team workshop: Who must be involved, what must be preserved and, how can counsel proactively prepare for litigation holds? Who can be deposed under Rule 30(b)(6)? A panel of corporate counsel, IT, outside counsel, and a litigation partner will provide insight as they take us through a hypothetical.
- Secrets of experts: Strategic partners and forensic experts reveal what they look for and where they look. These experts will offer ideas for risk assessment, cost containment, preservation strategies, review, sampling, hosting, request strategies, production, responses, and more.
- Ethical challenges: Both inside and outside counsel have duties related to preserving data and defining privilege. These ethical issues, as well as "clawbacks" and the impact of new Evidence Rule 502, will be discussed.
