Erin Casey is a principal in the firm's Bankruptcy & Creditors' Rights Group. She represents lenders in all aspects of corporate bankruptcy cases and commercial workouts throughout the country. Her experience includes negotiation and litigation of debtor-in-possession financing orders, cash collateral orders and sale orders in bankruptcy cases, as well as documentation of asset-based and cash-flow commercial finance transactions. Ms. Casey has also represented a broad range of clients in acquisitions and sales of stock and assets, collateral turnover arrangements, and leveraged lease transactions.
Ms. Casey is a faculty member at the University of Chicago Law School as a Lecturer in Law. Her courses focus on the structuring and documentation of secured loan transactions and related workout topics. She is also a member of the American Bankruptcy Institute, the Turnaround Management Association and the Real Estate Finance Forum. She was selected for inclusion on the 2011 Illinois Rising Stars list, appearing in Super Lawyers and Chicago magazines.
Ms. Casey is a frequent writer and speaker on bankruptcy and commercial finance issues. She co-authored a featured article, The Pre-Petition Right to Post-Petition Income Streams and the Misinterpretation of § 552, in the December/January 2011 volume of the American Bankruptcy Institute Journal and served as moderator for the panel, “How Entrepreneurial Lenders & Factors Win a Bankruptcy Preference Claim…or Lose it!” at the 2010 Commercial Finance Association’s Annual Convention. Ms. Casey is on the Content Update Committee of Troubled Loan Workouts: A Reference Guide and was elected to participate in the 2009 Troubled Loan Workouts Project through the National Turnaround Management Association's Education Oversight Committee. She was a featured speaker for the Chicago Bar Association panel, "The Rights of Creditors: Issues in the Trading of Claims," which addressed issues concerning the buying and selling of claims in chapter 11 cases. Ms. Casey was also a panelist for the Illinois Institute for Continuing Legal Education's program "Workouts & Turnarounds: Non-Bankruptcy or Pre-Bankruptcy Solutions for the Distressed Business." Ms. Casey frequently gives presentations on debtor-in-possession financing, bankruptcy case studies and workout strategies.
Ms. Casey is admitted to practice in Illinois and New York, and in the United States District Courts for the Northern District of Illinois, Central District of Illinois, Southern District of New York, Eastern District of New York, and various other District Courts.
She received her law degree from the University of Chicago Law School in 2002 and her B.A., with honors, in economics, from the University of Chicago in 1999.
