Dimitri G. Karcazes, principal in the firm's Bankruptcy & Creditors' Right Group, is participating in a teleconference entitled, "The New ABA Model Intercreditor Agreement," hosted by the American Bar Association's Section of Business Law Commercial Finance Committee and the ABA Center for Continuing Legal Education on March 25, 2010.

The teleconference will present information about a new Model First Lien/Second Lien Intercreditor Agreement completed by the ABA Task Force. The Model Agreement offers guidance on the many difficult issues facing lawyers representing first lien lenders and second lien lenders dealing with existing agreements inside and outside of bankruptcy and in negotiating new agreements in this changing marketplace.

Mr. Karcazes will present specifically about bankruptcy provisions, including use of cash collateral, consent to Section 363 sales and adequate protection.

Mr. Karcazes is a frequent speaker on bankruptcy and commercial finance issues. He was a panelist at the Ocean Tomo 2008 Intellectual Property Conference on a panel entitled "IP Value in Workout/Bankruptcies." His presentation at the INSOL Europe Annual Conference in Monaco dealt with cross-border insolvencies and Chapter 15 of the Bankruptcy Code. He has also given recent presentations on debtor-in-possession financing, asbestos bankruptcies and the Pension Benefit Guaranty Corporation and participated as a panelist for a Chicago Bar Association seminar, “Buying and Selling Distressed Assets.”
