Goldberg Kohn Successfully Advocates for New Law Limiting Use of Juvenile Shackling

Goldberg Kohn is pleased and proud to report that, due in part to a pro bono advocacy and research piece prepared by Goldberg Kohn in partnership with the Chicago Appleseed Fund for Justice, the Supreme Court of Illinois passed into law on October 6th a new rule prohibiting the use of shackles or other "instruments of restraint" on a minor during a juvenile court proceeding absent a specific finding, after hearing, that the minor poses a flight or safety risk.  This new presumption against juvenile shackling will change the practice in Illinois' juvenile courts, where some judges have been routinely shackling minors in violation of constitutional principles and at great risk of lasting psychological harm.  The Supreme Court considered and accepted Goldberg Kohn's legal review, authored by Emily Gilman, in passing this new rule.
