David Morrison, a principal in the firm's Litigation and Labor & Employment groups, is quoted in "Workplace Drug Testing: What to Do When Employees Fail?," published in the Jan. 21, 2020, edition of SHRM.org.

With more states legalizing marijuana for medical and recreational purposes, the article advises employers on what they should do if their employee fails a drug use test. The article addresses firm policies, including a medical review process, determining what steps to take, making reasonable accommodations and disciplinary action.

"Employers should have a comprehensive drug-free-workplace policy and drug-testing procedures that are followed consistently in all circumstances," said Mr. Morrison, "because employers that inconstantly apply drug-testing procedures may be sued for discrimination."
