Workplace Drug Testing: What to Do When Employees Fail

David Morrison, a principal in the firm's Litigation and Labor & Employment groups, was recently quoted in SHRM.org's article "Workplace Drug Testing: What to Do When Employees Fail?"  With more states legalizing marijuana for medical and recreational purposes, the article advises employers on what they should do if their employee fails a drug use test.  The article covers, keeping consistent policies, including a medical review process, determining what steps to take, making reasonable accommodations and disciplinary action.
