Randall Klein, chair of the firm's bankruptcy group, and Danielle Juhle, associate in the firm's bankruptcy group, co-authored the article "Majority Rules: Non-Cash Bids and the Reorganization Sale" in the September 2010 issue of the American Bankruptcy Law Journal.
The article reexamines the "credit bid" conundrum, focusing on multi-lender credit facilities where each lender individually has a debtor-creditor relationship with the borrower, and illustrates the application of majority rule in today's restructuring environment.
