  • Assisted secured lender in the reviewing, negotiating and drafting of the documentation related to a consensual DIP facility as well as assisting with the financing documentation related to a stalking horse purchaser in its borrower’s Chapter 11 case.
  • Represented secured lender in navigating issues with respect to restructuring a credit facility and the eventual sale of its borrowers’ business. Helped implement a sale strategy under Article 9 of the UCC, successfully coordinating and concluding multiple independent sale transactions for different elements of the business resulting in secured lender being paid substantially in full.
  • Assisted senior secured lender in navigating the workout of a distressed borrower, from executing a forbearance agreement through the eventual assignment and assumption of senior secured lender’s revolving facility.
