On April 9, 2026, Goldberg Kohn Litigation Principal Chip Mulaney will moderate “Enforcement Beyond § 1592,” a panel discussion at the 24th Annual Dominick L. DiCarlo U.S. Court of International Trade Lecture, an online CLE program presented by the University of Illinois Chicago School of Law.
Within the theme of "Trade Compliance in 2026," the program will provide a timely look at key compliance questions for importers facing new, changing and overlapping tariffs. Panels will focus on customs valuation and transfer pricing, the growing use of the False Claims Act for enforcement, and an update on litigation challenging the use of the International Economic Emergency Powers Act to impose tariffs.
At 10:05 a.m., Chip will moderate “Enforcement Beyond § 1592.” Importers are facing an increase in the government’s use of the False Claims Act (FCA) and the Enforce and Protect Act (EAPA) to enforce tariffs. The panel will focus on the current types of tariff evasion targeted by the government and whistleblowers — such as undervaluation, misclassification, false country of origin, and transshipment. The panelists will discuss how FCA damages and reverse false-claim theories may be affected by the Supreme Court’s pending case on President Trump’s 2025 IEPPA tariffs (Trump v. V.O.S. Selections). Finally, they will discuss DOJ’s creation of the Trade Fraud Task Force and recent high-profile settlements, which will illustrate what importers will face when these actions arise.
The Dominick L. DiCarlo U.S. Court of International Trade Lecture will take place from 9 a.m. to 3:30 p.m. Central Time on April 9, 2026, and qualifies for up to 4.25 CLE credits. In addition to Chip’s panel, the others are:
