Richard Kohn, a Principal in Goldberg Kohn's Commercial Finance group, participated as a panelist in a recent Colloquium conducted by the United Nations Commission on International Trade Law (UNCITRAL) held at UN Headquarters in New York on February 10-13, 2026. The Colloquium was entitled “Harmonizing Law in the Age of Digital Trade and Finance.” 

Richard’s presentation was entitled “Promoting Cross-Border Financing,” and his thesis was that UNCITRAL is in an ideal position to promote the financing of digital assets by encouraging countries to remove some of the existing legal and economic barriers to cross-border financing in general, such as restrictions on making loans and taking collateral by foreign lenders, financial assistance laws, withholding taxes, limitations of the enforceability of upstream and cross-stream guaranties, insolvency laws that discourage consensual workouts of loans, and the enforceability of “anti-assignment clauses” for receivables.
