The Secured Lender

Richard Kohn, principal in the firm's Commercial Finance Group, and Randall Klein, chair of the firm’s Bankruptcy Group, co-authored the article "The Rising Tide of Anti-Creditism," published in the July/August 2010 issue of The Secured Lender (the magazine of the Commercial Finance Association). The article discusses various recent judicial decisions that have eroded the rights of secured lenders.

Richard Kohn practices extensively in the field of cross-border asset-based lending, and has written and lectured extensively on the subject. He is also Co-General Counsel of the Commercial Finance Association and a Fellow of the American College of Commercial Finance Attorneys, and for the past ten years has been active on various projects for the United Nations Commission on International Trade Law (UNCITRAL) in the area of international secured transactions.

Randall Klein concentrates his practice in the area of the protection and enforcement of creditors’ rights, representing institutional lenders and purchasers of distressed claims. He is an author and frequent speaker on bankruptcy and workout topics. He is Vice Chair of the ABA's Model Intercreditor Agreement Task Force and is a Fellow in The American College of Bankruptcy.
