Coronavirus Complicates Workplace Drug-Testing Programs
David Morrison, a principal in the firm's Litigation and Labor & Employment groups, was recently quoted in SHRM's article "Coronavirus Complicates Workplace Drug-Testing Programs." The article looks at how the impact of coronavirus has complicated some safety programs, such as drug-free workplace initiatives. As in-person testing is more difficult and employers don't want to put workers at risk, employers may want to focus on reasonable suspicion of on-the-job impairment.
Mr. Morrison, "suggested that when employers are seeking to test only for impairment, they should train managers and supervisors on ways to reasonably observe when someone is working under the influence."
