Shoring Up Distressed Cross-Border Loans

Richard Kohn, a principal in the firm's Commercial Finance Group, co-authored the article "Shoring Up Distressed Cross-Border Loans" in the current July/August issue of The Secured Lender (the magazine of the Commercial Finance Association).  The article shows lenders how to use non-U.S. assets to shore up distressed cross-border loans, or even purely domestic U.S. loans where the borrower or its affiliates own property in other countries that was not included in the original loan transaction due to cost, tax or other considerations.  

Also featured in the same issue of The Secured Lender is an opinion piece co-authored by Richard Kohn and Principal Jonathan Cooper urging the ratification of the United Nations Convention on the Assignment of Receivables in International Trade.

Richard Kohn and Jonathan Cooper practice extensively in the field of cross-border asset-based lending, and have written and lectured extensively on the subject.  They both represented the Commercial Finance Association in connection with the Convention referred to above.  Mr. Kohn is also Co-General Counsel of the Commercial Finance Association and currently consults to the U.N. in the area of international secured transactions.
