Meredith Kirshenbaum, an associate in the firm's Litigation Group, has authored "Bargaining with Combined Units: What It Means for Employers," published by the Society For Human Resource Management on Aug. 14, 2017.
The article addresses the growing challenge of combined bargaining units under recent National Labor Relations Board decisions, including Browning-Ferris Industries and Miller & Anderson, Inc. Those recent Board decisions make the possibility of combined bargaining units – units including both permanent employees and staffing agency employees - more likely, creating potentially complicated bargaining obligations for employers. Ms. Kirshenbaum touched on options for employers to consider moving forward, as well as the potential impact of recent Board nominations on the future of combined bargaining units.
