Overview

Rachel Steiner is a member of the firm's Litigation Group. She represents for-profit and not-for-profit businesses, government entities, and individual clients in complex commercial litigation involving claims as varied as breach of contract, breach of fiduciary duty, computer fraud and abuse, misappropriation of trade secrets, judgment enforcement, equal protection violation, discrimination, retaliatory discharge, and mortgage foreclosure.  

Rachel has litigated cases in federal and state courts, at the trial and appellate levels, as well as before administrative agencies. She has substantial experience moving litigation matters forward from initial assessment through resolution by dispositive motion, settlement, trial, and appeal. She also has experience counseling clients regarding a variety of business matters, including making employment decisions, implementing policies and procedures, and adapting to emerging legal issues. 

Experience

  • Defended a Fortune 100 company in federal district court against allegations of disability discrimination in the provision of public services, including a successful motion to dismiss the Title III Americans with Disabilities Act claim and a successful motion for summary judgment on the Rehabilitation Act claim. 
  • Defended an administrative agency in federal appellate court against allegations of equal protection violation in connection with a Disadvantaged Business Enterprise (DBE) contracting program, resulting in a successful affirmance of the favorable summary judgment ruling. 
  • Represented a judgment creditor in a judgment enforcement action, including a successful remand from federal to state court for improper removal by the judgment debtor. 
  • Defended a municipality in a federal investigation of compliance with securities laws and related litigation, including a first-of-its-kind motion by the U.S. Securities and Exchange Commission to enjoin a municipal bond offering resulting in the entry of a consent decree.
