Meredith Kirshenbaum Presenting on the Effects of the NLRB's McLaren Macomb Decision
Meredith Kirshenbaum will serve on a panel that will discuss the effects of the National Labor Relations Board's McLaren Macomb decision at a Labor and Employment Relations Association Chicago Chapter meeting. The meeting will take place on April 25, 2023, at the Chicago-Kent College of Law.
Meredith's fellow panelists will include Dale Pierson, who is General Counsel of IUOE Local 150, and Pat O'Gorman, who is an Organizer with IUOE Local 399, as well as other Chicago area labor law attorneys.

About the McLaren Macomb Decision
On Feb. 21, 2023, the National Labor Relations Board ruled in McLaren Macomb, 372 NLRB No. 58, that the mere proffer of a draft severance agreement containing broad confidentiality and non-disparagement provisions violated the National Labor Relations Act (NLRA).
Since the Board issued its decision, employers have been left wondering whether and how to include confidentiality and non-disparagement clauses in their severance agreements. In an effort to help guide employers on the breadth of the Board’s decision, and how to comply with the new rule, General Counsel (GC) Jennifer Abruzzo released Memo 23-05 on March 22, 2023. The memo attempts to instruct the Board’s regional offices on how to respond to inquiries about implications arising from the McLaren Macomb decision.
