The firm represents major manufacturers, retailers, entertainment media and not-for-profit entities with respect to all intellectual property including their trademarks, copyrights, domain names, patents, trade secrets, licensing/distribution agreements and advertising.

Representative Matters

  • Goldberg Kohn brought suit against a corporation and its officers who were violating Fender's trademark rights by selling illegal gray market and counterfeit goods, and representing the corporation's stores as authorized dealers of Fender products. See Fender Musical Instruments Corp. v. Unlimited Music Center Inc., 1995 WL 241990 (D. Conn.). The firm obtained a summary judgment on Fender's behalf, resulting in a seminal ruling on the enforceability of certain of Fender's rights.
  • Goldberg Kohn has served as primary patent enforcement counsel for a national toy and novelty manufacturer with respect to counterfeit toys and novelty items manufactured and imported from overseas.

  • Goldberg Kohn served as counsel for one of the nation's largest wireless communications providers in as intervenor in proceedings before the International Trade Commission, including four days of evidentiary hearings before an administrative Law Judge and two days of evidentiary hearings before the plenary Commission. The proceedings related to a petition by a chip manufacturer to exclude goods including certain cellular telephone handsets from being imported into the United States. The firm's client opposed the petition which would have resulted in several billions of dollars of potential loss to the client. The Commission denied the complainant's petition in part and granted the petition in part. The portion of the Commission's order that granted relief was later overturned on appeal.

  • Represented a Defendant in TRO proceedings in a patent ownership dispute in the paper-processing industry. Goldberg Kohn successfully defeated the TRO and the matter resolved shortly thereafter.

  • Represented a national research laboratory in litigation involving trade secrets, violations of state and federal law, and claims under the patent laws relating to the inventorship and ownership of certain issued patents. The cases include one in Federal Court in California; one in state court in California;  two in state court in Chicago; and an appeal to the Federal Circuit.
