Goldberg Kohn Secures Win on Behalf of Landlord, Rejecting Tenant Banana Republic’s COVID-19 Defenses to Rent Payments
Fred Klein is a Principal in the Litigation Group. For more than 30 years he has represented clients in federal and state courts and before arbitration panels, including large law firms in legal malpractice matters; substantive practice areas implicated by the malpractice claims include tax, securities, M&A, banking, estate planning, customs duties, and others. In addition, he regularly represents clients in intellectual property, trade secrets, contract, constitutional, real estate, environmental, and corporate control litigation and disputes. He represents clients in a variety of industries, including the legal profession, higher education, telecommunications, natural resources, commercial real estate, national retailing and banking.
In recent years, Fred has engaged in numerous complex mediations of difficult disputes, almost always resolving these matters. He has also argued cases before federal and state appellate courts, and has conducted sensitive internal investigations directed by senior management and boards of governing bodies. Since early 2020, he and his Goldberg Kohn colleagues have had significant successes for clients of the firm, including four appellate wins (one after winning before a jury in state trial court, one after prevailing in a JAMS arbitration, and two after obtaining dismissals with prejudice); four trial court wins of motions to dismiss with prejudice (two federal and two state); and one settlement for 25 percent of the law firm's self-insured retention.
