Bankruptcy & Creditors' Rights
Goldberg Kohn is one of the nation's leading bankruptcy and restructuring firms in the middle-market. The Bankruptcy & Creditors’ Rights Group has a reputation for being cutting-edge in its legal positions and best practices, as well as for being creative and sophisticated deal-makers.
The group's foundation rests upon serving the firm's commercial lending clients. The firm represents many of the nation's largest banks, financial institutions, and hedge funds. Whether or not the firm originally documented a deal, agents, lenders, and participants seek the group's result-driven and efficient approach to troubled credits. Goldberg Kohn's commercial bankruptcy lawyers are intimately familiar with the nuances of loan documents, credit policies, market trends, and the politics of syndicated situations. Inter- and intra- class lender negotiations and disputes are a particular specialty, as is litigation involving cash collateral and postpetition financing issues.
The Bankruptcy & Creditors' Rights Group supplements its lender representations by representing virtually all other types of parties in upper and middle-market situations, including large trade creditors, asset purchasers, committees, trustees, and debtors in select situations. In this regard, the firm has had singular success as counsel to asset purchasers in Chapter 11 bankruptcy cases, secondary debt market participants, and various constituents of the automotive industry.
Goldberg Kohn has a strong team of professionals dedicated to the practice of insolvency law. Ronald Barliant is a former bankruptcy judge and Fellow of the American College of Bankruptcy. Randall Klein, the group chair, has over 30 years of bankruptcy experience and is also a Fellow of the American College of Bankruptcy. Dimitri Karcazes and Jeremy Downs have over 20 years in the Group. The Group's newest principals, Danielle Juhle, Zachary Garrett and Prisca Kim, have also spent their entire careers focused on creditor's rights and other insolvency matters. Likewise, the group's associates are highly talented and capable lawyers, with training and experience beyond their years. As a result of this concentration, Goldberg Kohn offers its clients leading insolvency counsel, unlike firms that task other types of practitioners to serve this critical need.
