Overview

Goldberg Kohn's Labor & Employment lawyers offer a wide spectrum of experience advising employers nationwide with respect to their policies and practices, and defending them in disputes with their employees before courts and in mediations or arbitrations. Our team assists clients through a myriad of issues, including decisions regarding hirings, layoffs and terminations; advising on the labor/employment implications of significant corporate transactions, such as mergers, sales, acquisitions, workouts and bankruptcies; and representing clients before federal and state courts, local, federal and state agencies, the Equal Opportunity Commission, the National Labor Relations Board and the Department of Labor.

Our lawyers have litigated and tried single plaintiff, multi-plaintiff and class action employment cases involving discrimination, harassment, retaliation, wrongful termination, FEHA, violation of public policy, and a variety of state law tort claims. We defend employers in cases brought under the FLSA, state minimum wage laws and privacy laws, including the Illinois Biometric Information Privacy Act (BIPA). Our team also represents employers in breaches of covenants not-to-compete or other restrictive covenants, breaches of fiduciary duty or confidentiality agreements, and violations of state and federal trade secret acts. 

In addition, Goldberg Kohn counsels employers on matters such as handbooks and policies, reductions in force, terminations, various agreements (i.e., employment, compensation, separation, severance, temporary employee, covenants-not-to-compete, restrictive covenants and confidentiality), wage and hour issues, privacy, misclassification and independent contractor issues, WARN, ADA and the FMLA. 

Goldberg Kohn also represents employers who face union-related legal issues before the NLRB, including in unfair labor practice hearings, decertification proceedings and grievance arbitrations. Our lawyers counsel employers during union organizing campaigns and defend their interests throughout the union election process. In addition, we are experienced in handling difficult and expedited labor proceedings, including strikes, picketing and emergency litigation in federal court.
