Litigation & Dispute Resolution
Business disputes are an unfortunate but inevitable byproduct of business activity. Serious disputes can be an extraordinary drain on management's time and on an enterprise's capital. Accordingly, each dispute must be dealt with effectively and efficiently. Goldberg Kohn's Litigation Group has a reputation for possessing a great depth of knowledge about the firm's clients and their business issues, being highly strategic and tenacious, and producing excellent results. The firm's litigators combine professional aggressiveness with legal creativity.
Goldberg Kohn has served as Illinois, Midwest and national litigation counsel to clients ranging from private to Fortune 100 companies, as well as domestic counsel to companies headquartered throughout the world. The efforts of Goldberg Kohn’s litigators foster long-term client relationships and recognition at the local, state and national level for outstanding litigation achievements.
When clients engage Goldberg Kohn litigators to assist in the resolution of a business dispute, the firm's attorneys determine the client's specific goal, gather the facts, evaluate the legal issues, and then focus their efforts on achieving that goal efficiently. If the objective can be achieved by settlement, the firm's litigators are skilled negotiators within and outside mediation settings. If a matter can be resolved by summary legal disposition, Goldberg Kohn targets that result. If clients wish to avoid courtroom litigation, the firm's attorneys guide the matter through arbitration or other conflict resolution processes.
When the client's best interest is to try a case, Goldberg Kohn has a long history of achieving outstanding results at trial. Likewise, when matters go to reviewing courts, Goldberg Kohn has had a remarkable record of success on appeal in the United States Supreme Court, the United States Court of Appeals for the Seventh Circuit (and many other Circuits Courts of Appeal), the Illinois Supreme Court, and the Illinois Appellate Court (all Districts). Goldberg Kohn has tried and litigated many cases in federal and state courts all over the country, both jury and bench, before administrative agencies, and in front of arbitration panels, including the American Arbitration Association (AAA), Judicial Arbitration and Mediation Services (JAMS), Federal Mediation and Conciliation Service (FMCS), and the International Institute for Conflict Prevention and Resolution (CPR). In addition, the firm’s attorneys have litigated matters before both the Financial Industry Regulatory Authority (FINRA), and the Chicago Board Options Exchange (CBOE).
A federal district court judge wrote in a recent opinion that the firm's Litigation Group's credentials were "excellent," explaining that Goldberg Kohn "has extensive experience in complex litigation and with class action lawsuits. Competent litigators (like judges) are generalists, not specialists, and often handle complex cases in a variety of fields." This is true of Goldberg Kohn's depth and breadth of practice.
